does this mean that my  male is not fertile

Hi, you can plot his size and weight on the Jackson Ratio to check if he is on course, here is the link http://www.tortoise-protection-group.org.uk/site/169.asp. But bear in mind that all tortoises grow at different rates.

Regarding the eggs, did you put them in an incubator and check the temperatures and humidity levels.  The eggs will only fertilise and grow if the conditions are spot on.  It could also be that the either the male or female is not sexually mature enough to be producing viable eggs/sperm.  Only time will tell, if and when you get more eggs.
